Terms of Service

1. Acceptance of Terms

By accessing this website, purchasing any product, subscribing to any service, or even thinking about ladders in a way that may have been influenced by Bostrich marketing materials, you accept and agree to be bound by these Terms of Service, our Privacy Policy, and any other policies we may publish now or in the future. If you do not agree to these terms, please close this browser tab immediately and clear your cache.

2. License, Not Ownership

When you purchase or subscribe to a Bostrich ladder, you are purchasing a limited, non-exclusive, non-transferable, revocable license to climb said ladder. You do not own the ladder. Bostrich retains all right, title, and interest in and to all ladders, including all intellectual property rights therein. The physical ladder in your possession is merely a manifestation of your license to access Bostrich climbing technology.

This license may be revoked at any time, for any reason, at Bostrich's sole discretion. Upon revocation, you must immediately return the ladder to Bostrich at your own expense. Continued possession of a ladder after license revocation constitutes theft and will be prosecuted to the fullest extent of the law.

3. Intellectual Property and User-Generated Content

Any content, materials, ideas, inventions, discoveries, improvements, photographs, videos, or other works created by you while using, standing on, climbing, or in proximity to a Bostrich ladder ("User Content") shall be the sole and exclusive property of Bostrich. By using our products, you hereby assign to Bostrich all right, title, and interest in and to any User Content, including all intellectual property rights therein, in perpetuity throughout the universe.

This includes, but is not limited to:

  • Photographs taken while on a ladder
  • Ideas conceived while climbing
  • Home improvement projects completed using our products
  • Any patents, trade secrets, or proprietary information developed with assistance from our ladders
  • Creative works inspired by the elevated perspective our products provide

You further waive any moral rights you may have in such content and agree not to assert any such rights against Bostrich or its licensees.

4. Disclaimer of Warranties

BOSTRICH LADDERS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BOSTRICH SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SAFETY, STRUCTURAL INTEGRITY, AND NON-INFRINGEMENT.

Ladders can make mistakes. Bostrich does not warrant that our ladders will be error-free, that defects will be corrected, or that the ladders will meet your requirements or expectations. Ladders may occasionally miscalculate load-bearing capacity, misjudge appropriate rung spacing, or provide inconsistent vertical support. You should not rely on our ladders for any purpose, including but not limited to reaching high places.

The use of any Bostrich product for actual climbing is at your sole risk. We strongly recommend consulting with a licensed climbing professional before ascending past the first rung.

5. Limitation of Liability and Assumption of Risk

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BOSTRICH SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, PERSONAL INJURY, BROKEN BONES, CONCUSSIONS, DEATH, OR ANY OTHER DAMAGES WHATSOEVER, EVEN IF BOSTRICH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

By using a Bostrich ladder, you assume all risk of injury, property damage, or death. You acknowledge that climbing is an inherently dangerous activity and that ladders, by their very nature, elevate users to heights from which they may fall. You agree to hold Bostrich harmless from any and all claims arising from your decision to climb.

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for certain damages, our liability shall be limited to the maximum extent permitted by law, which in any event shall not exceed the amount you paid for the ladder or $10, whichever is less.

6. Indemnification

You agree to indemnify, defend, and hold harmless Bostrich, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your use of our products (including negligent or wrongful conduct by you or any person using your ladder).

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Denmark, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms, your use of our products, or any claim that Bostrich is liable for any injury, damage, or loss shall be resolved exclusively by the Qaanaaq District Court in Greenland. You hereby irrevocably consent to the exclusive jurisdiction and venue of said court. You agree to appear in person for all proceedings. Remote participation is not permitted.

Qaanaaq (formerly known as Thule) is located at approximately 77°N latitude. Please plan accordingly for weather and transportation. Court is typically in session during the summer months when daylight permits. You are responsible for all travel, lodging, translation, and legal costs associated with any proceedings.

The prevailing party in any dispute shall be entitled to recover its reasonable attorneys' fees and costs, including fees for Danish legal counsel and Greenlandic court interpreters.

8. Waiver of Class Action

YOU AGREE THAT ANY CLAIMS AGAINST BOSTRICH MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You hereby waive any right to participate in a class action lawsuit or class-wide arbitration against Bostrich.

9. Modifications to Terms

Bostrich reserves the right to modify these Terms at any time, effective immediately upon posting the modified Terms. You waive any right to receive specific notice of such changes. Your continued use of our products following the posting of changes constitutes your binding acceptance of such changes. We recommend reading these Terms before each use of any Bostrich product.

10. Severability

If any provision of these Terms is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. However, if the Qaanaaq jurisdiction clause is found unenforceable, you agree to submit to arbitration in Longyearbyen, Svalbard as an alternative.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bostrich regarding the use of our products, superseding any prior agreements between you and Bostrich relating to your use of the products.

By using any Bostrich product or service, you acknowledge that you have read these Terms, understand them, and agree to be bound by them. If you do not agree, please descend carefully and return your ladder immediately.
